Fraud, deceit about lineage prompts court ruling forcing wife to divorce husband

A case that is currently being heard in the special court in Al-Ayina about social incompatibility between a husband and wife remains a hot topic of discussion among the public after the issuance of a preliminary ruling by the court forcing the wife to leave her husband.

While the new ruling was in agreement with a previous ruling, the case has once again resurfaced after press sources confirmed that the main reason for the issuance of the ruling was not social incompatibility and inequality between the spouses, as rumored, but rather deception and fraud in the original marriage contract, which made it invalid.

This revelation prompted the judge to rule in favor of the dissolution of the marriage contract, however the lawyer of the husband has appealed the ruling, sources revealed.

A judicial source confirmed to local press that the public court judge in Al-Ayina previously ruled in favor of the dissolution of the marriage contract after the husband was found to have deceived his wife’s guardian. After several weeks of looking into the case and listening to various view points, the judge issued a ruling based on new evidence that the husband had deceived the appointed guardian from the court by failing to reveal his full name and true lineage when proposing marriage to the girl. As such, the guardian completed the contract based on information that later turned out to be untrue.

The source said that the rumors circulating on social media that the case was reviewed on the basis of a lack social compatibility and equality between the spouses is inaccurate, adding that the case was in reality about the fraud and deception of the wife’s guardian in order to prompt him to finalize the marriage contract. He also said there was no truth to the accusation that the ruling was for the wife to divorce her husband; rather, he noted that the ruling had called for the dissolution of the marriage contract altogether.

The husband responded to the accusations of fraud and deceit by stating that he presented a list of discrepancies and objections to the reasons on which the judge built his ruling against him, but said that they were not looked into.

Since the issuance of the first preliminary ruling a number of months ago, he said that he presented a list of objections, which included objections related to the accusations of deception and fraud. He said that such charges were neither fabricated nor proven, and that the judge did not review this in his discussion of the cases. “I said that it was social incompatibility in the marriage, and they are saying that it is deception and fraud to distract the public’s opinion away from the main issue, which is decency and social equality. I will continue to say and repeat that in order to confirm that I did not deceive or cheat anyone whatsoever,” he noted.

“I am prepared to prove this at any time, and the claims put forward by the prosecution is just a way for them to get out of the case and to separate my wife and my baby from one another in any way possible,” he concluded.
